AssuredPartners NL Controversy

AssuredPartners NL has been involved in a controversy with a former sales executive, Alan J. Jones, who left the brokerage to work for Alliant Insurance Services Inc.

Jones co-founded Louisville-based brokerage Neace Lukens, which AssuredPartners acquired in September 2011.

AssuredPartners claims that since Jones' resignation on July 1, it has received 40 broker of record letters, resulting in nearly $4 million in lost business.

Jones signed a senior management employment agreement with AssuredPartners that included noncompete, nonsolicitation, and confidentiality provisions.

AssuredPartners filed a motion for a temporary restraining order against Jones, seeking to bar him from soliciting employees and business from clients and using its confidential information.

Jones sued AssuredPartners on the same day he resigned, seeking a declaration that the restrictive covenant agreements were overbroad and would essentially bar him from working for any other broker.

AssuredPartners removed the lawsuit to federal court because damages exceed $75,000 and because the parties are from different states.

The brokerage also filed counterclaims against Alliant, Jones' former colleagues Mitchell Adamic and Desiree Brewer.
